1. About Aspirantz

Aspirantz ("we", "us", "our") provides AI-powered practice tests and study tools for the NSW Selective High School Placement Test, NAPLAN, and related Australian school assessments. These Terms & Conditions and Privacy Policy ("Terms") govern your use of our website at aspirantz.io and any associated services (the "Service").

2. Acceptance of Terms

By registering your interest, creating an account, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are completing this form on behalf of a child under 18, you confirm that you are the parent or legal guardian and that you consent to the collection and handling of the child's personal information as described below.

3. Use of the Service

• You agree to use the Service only for lawful, personal, non-commercial purposes.
• You will not attempt to gain unauthorised access to the Service, scrape content, reverse engineer features, or interfere with its operation.
• All content (practice questions, marking rubrics, analytics, branding) is owned by Aspirantz or its licensors and is protected by Australian and international copyright laws.

4. Accounts and Eligibility

To register interest you must provide accurate parent/guardian and student details. The parent or legal guardian must be at least 18 years old. You are responsible for keeping your account credentials confidential and for any activity that occurs under your account.

5. Privacy and Personal Information

We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This Privacy Policy explains how we collect, hold, use, and disclose your personal information.

For the purposes of this policy, "personal information" has the meaning given in the Privacy Act and includes any information or opinion about an identified individual, or an individual who is reasonably identifiable.

6. What Information We Collect

We collect personal information that is reasonably necessary for our functions and activities, including:

• Identity and contact details — parent/guardian name, parent email address, child's first name, child's year group, and the exam goal you select.
• Optional information — any free-text notes you choose to submit (for example, a target school or specific subjects of concern).
• Technical information — IP address, browser type, device type, referring URL, pages visited, and approximate location, collected automatically when you use the Service.
• Communications — records of correspondence between you and Aspirantz.

We do not require sensitive information (as defined in the Privacy Act) to register interest. Please do not submit health, racial, religious, political, or other sensitive information through the form.

7. How We Use Your Information

We use personal information for the following purposes:

• To respond to your registration of interest and provide information about Aspirantz services.
• To provide, personalise, and improve the Service, including AI-marked practice tests and analytics.
• To communicate with you about service updates, security notices, and (where you have consented) marketing material.
• To comply with our legal obligations, including under the Privacy Act, the Spam Act 2003 (Cth), and applicable consumer law.
• To detect, investigate, and prevent fraud, abuse, or misuse of the Service.

8. Disclosure to Third Parties

We do not sell personal information. We may disclose personal information to trusted third parties only where reasonably necessary, including:

• Cloud hosting, email, and analytics providers acting on our instructions and bound by confidentiality and privacy obligations.
• Professional advisors (lawyers, accountants, auditors).
• Government, regulatory, or law enforcement bodies where required or authorised by law.
• A successor entity in the event of a corporate restructure, sale, or merger of Aspirantz.

9. Data Storage and Security

We take reasonable steps under APP 11 to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure, including:

• Encryption in transit (TLS) and at rest where supported by our providers.
• Access controls limiting personal information to authorised personnel only.
• Regular review of our security practices and supplier arrangements.

We retain personal information only for as long as necessary to fulfil the purposes described in this policy or as required by law. When no longer required, we will take reasonable steps to destroy or de-identify the information.

10. Your Rights — Access, Correction and Deletion

Under APPs 12 and 13 you may:

• Request access to the personal information we hold about you.
• Request correction of information you believe is inaccurate, out of date, incomplete, irrelevant, or misleading.
• Request deletion of your information, subject to any legal or operational retention requirements.

Requests can be sent to hello@aspirantz.io. We will respond within a reasonable period (generally within 30 days). We may need to verify your identity before actioning a request.

11. Direct Marketing and Spam Act

Where we send commercial electronic messages, we comply with the Spam Act 2003 (Cth). Every marketing email will identify Aspirantz as the sender and include a functional unsubscribe link. You can withdraw consent at any time by clicking unsubscribe or by emailing hello@aspirantz.io. Service-related communications (for example, account or security notices) are not marketing and may continue while your account is active.

12. Cookies and Analytics

We use cookies and similar technologies to operate the Service, remember preferences, and measure usage. You can control cookies through your browser settings; disabling cookies may affect parts of the Service. Where we use third-party analytics tools, those providers handle information in accordance with their own privacy policies and our data processing arrangements with them.

13. Information About Children

The Service is intended to be used by parents or legal guardians on behalf of their children, or by young people with parental consent. By submitting information about a child, you confirm that you are the child's parent or legal guardian and that you have authority to provide that information. We collect only the minimum information about a child needed to provide the Service (typically first name, year group, and exam goal). Parents and guardians may request access to, correction of, or deletion of their child's information at any time.

14. Overseas Disclosure

Some of our service providers (including cloud hosting, email delivery, and analytics) may be located outside Australia, including in the United States and the European Union. Where personal information is disclosed overseas, we take reasonable steps under APP 8 to ensure the recipient handles it consistently with the APPs, including through contractual safeguards.

15. Liability and Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Aspirantz excludes all warranties, conditions, and representations not expressly set out in these Terms. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded. Our liability for breach of any non-excludable consumer guarantee is, where permitted, limited to re-supplying the Service or paying the cost of having the Service re-supplied.

16. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when the Terms were last revised. Material changes will be communicated through the Service or by email where appropriate. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Complaints and Contact

If you have a privacy concern or complaint, please contact our Privacy Officer at hello@aspirantz.io. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days.

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia for any dispute arising out of or in connection with these Terms.
